1 Appellant, Jon Robert Flynt, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Comanche County, Case No. CRM-72-327, for the crime of Driving While Under the Influence of Intoxicants. He was sentenced to serve a term of ten (10) days in the County Jail, and pay a fine of One Hundred Dollars ($100.00), in accordance with the verdict of the jury, and a timely appeal has been perfected to this Court.
