FACTS. - Union Pacific conveyed land to Newton, and Newton transferred the mineral estate to Champlin, with Newton having a right to receive 2 1/2% of certain proceeds in cash. Newton thereafter conveyed "one half of the royalty (of any type) from production of minerals..." to Bass. Newton also conveyed half the "royalty of any type" to Flying Diamond. Champlin discovered oil and gas, and paid most of the 2 1/2% into escrow pending this case.
